Terms & Conditions

Opaline S.r.l., with registered office in Milan, Via Savona 19 / tax code  and VAT number 08065070966 registered at the Milan Companies House (hereinafter "Opaline") owns and runs the website www.opalineworld.com (hereinafter the "Website") for the online sale of products under the trademark Opaline ® (hereinafter the “Products ").


1. Scope of this Agreement
These Terms and Conditions govern the offer and sale of the Products through the Website. By using the Website, Customers agree to these Conditions of Sale and therefore Opaline invites everybody to them carefully.
These Conditions of Sale may, at any time, be unilaterally updated and/or amended by Opaline. Therefore we recommend Customers to regularly access these Terms and Conditions before placing an order.
In the event that the Customer does not agree, in whole or in part, with these Terms and Conditions, please refrain from placing any order and from using the Website.
 
2. Customer’s Obligations
Customers placing orders declare to have examined and accepted the Conditions of Sale.
Customers shall not use or communicate false or misleading information during the registration procedure and in any further communication with Opaline. Customer are therefore solely responsible for the truthfulness and correctness of the information and data provided to Opaline and undertakes to communicate any related changes to the information or data provided. Customers declare to be at least of 18 years of age.
 
3. Purchase
Opaline offers through its website offers the sale of high quality Products. Each Product sold through the Web Site is accompanied by an accurate and detailed description of its essential qualities. Opaline does not guarantee that the images and colors of the Products correspond exactly to the actual ones, as they may be modified depending on the type of monitor or internet browser used by Customers.
Customers who intend to purchase the Products will have to follow the instructions on the Web Site by placing an invitation to offer according to art. 1326 of the Italian Civil Code. The contract is concluded at the headquarters of Opaline in Via Savona 19/A, Milan Italy.
Opaline’s acceptance of the Customers’ offer will be confirmed by email sent to the Customers’ email address provided when the order is completed and will contain a summary of the order made, the products purchased, and the link to these Terms and Conditions of Sale.
The Contract will be concluded and fully effective once the full payment is completed. The conclusion of the Contract is however conditioned to the actual availability of the products in stock. For this reason, even after the acceptance of the offer, Opaline shall not be liable for the unavailability of products.
Opaline is committed to promptly notify Customers of any stock unavailability due to excess demand or to other causes. It is understood that in case of permanent unavailability of the Product, Opaline’s liability shall be limited to the refund of the price paid.
Opaline remains free not to accept incomplete and / or non-regular purchase orders.
 
4. Payments
Product prices may be subject to changes; before placing the order, Customer are invited to check the exact amount of the final price.
Opaline offers Customers different payment methods via secure system.
If payment is made by credit card, the financial information provided by Customers when (number of credit / debit card, expiration date) will be sent by encrypted protocol to the bank which provides remote electronic payment services.
Opaline will only use this information to complete the Customers’ purchase or to reimburse the amount paid in the event a product is not available after payment or in case of exercise of the right of withdrawal, or to prevent or report to the competent frauds to the Competent Authorities. Opaline does not accept payments on delivery or by bank transfer.
 
5. Consumer code
The sale of products on the Web Site is subject to the current legislation according to the Legislative Decree no. 6 September 2005, n. 206 and subsequent amendments.
 
6. Shipping & Returns
Opaline delivers the products to Customers  with express free shipping service DHL worldwide. Opaline provides free shipping and VAT included in the final price. However custom duties may apply for shipment of our product to certain countries.
Shipments are usually made from Monday to Friday between 9:00 and 17:30.
The delivery time may vary depending on the product and is usually indicated on the online form. In the absence of indications expressed on shipping times, the products will be shipped within 3 working days of receipt of payment.
The approximate time for delivery in Europe is 2-4 working days. However, remote areas may require longer delivery times.

According to Italian consumer protection law, products can be returned within 14 days from the date of sale. In such case, Opaline will charge the cost of the return of the product. The Customer is responsible for supplying due information to facilitate the return process.
 
7. Return Policy and Product Replacement.
Customers have the right cancel the order without penalty and without stating the reasons, within 14 working days from the day of the order.
To exercise the right of withdrawal, Customers, must inform Opaline of their decision to terminate the purchase to be sent, by mail, fax or email before the expiry of the 14 day term.
In case of withdrawal, Opaline shall reimburse the customer all sums paid, excluding shipping costs, taxes and custom duties. Customers shall bear the shipping  costs for the return of the Products to Opaline’s offices.
Opaline shall proceed to such reimbursement using the same method of payment used by Customers in the initial transaction, unless the same has expressly agreed otherwise; in any case, the customer will not incur any fees as a result of such reimbursement.
The refund procedure may be suspended until Opaline acknowledges the return of the goods by the customer.
In case of a Product return, Customer s shall send the original product as packed in its original packaging. The integrity of the goods to be returned is an essential condition for the legitimate exercise of the right of withdrawal.

9. Applicable Law and Dispute Resolution. Jurisdiction.
These Terms and Conditions of Sale are governed by Italian law. In case of dispute the court that will have jurisdiction in the place of residence or domicile of the Customers, subject to the possibility of operating the claims before the Court of Milan, in case the customer agrees.
